PRIVACY POLICY

This Privacy Policy covers all mobile apps owned and operated by Sphere of Influence, Inc. (“SOI”, “we”, “us”, “our”). We know that you care about how your personal information is used and shared, and we take your privacy seriously. Our Privacy Policy explains how we collect, use, and share information when you register for and use our mobile applications, including LMK, PubRally and Quack-a-Pult (our “Products”).

Information We Collect

For some of our Products, we may require you to create an account with us. When you register for an account, you are only required to provide your mobile phone number. We retain your phone number in encrypted format only.

If you use our Products to send other people (such as friends, relatives, and colleagues, etc) invitations, we ask for access to your address book or contact list. If you consent, we access mobile phone numbers in your address book and store the ones that are used for the service on our servers. We use that information to send the invitation as well as associate the phone number with any responses that you receive regarding the invitation. We retain the phone numbers used for this service in encrypted format only.

We collect certain information that you share with other people including text messages and photos. We retain that content on your behalf where we associate that with your account. Content may be stored in our systems for some period of time before being deleted.

PubRally includes a Rally service where we use your current location based on your mobile phone’s GPS coordinates to display a map of you and friends who are at the pub crawl. This helps you find and meet up with your friends. The Rally service is only available during the pub crawl where the service becomes available at the start time of the crawl and is unavailable once it ends. We ask for your permission to access your location for the Rally service. The Rally service is optional. If you elect to use the Rally service, PubRally periodically accesses and uploads your location to our servers.

Information We Do Not collect

We do not collect names, emails, addresses or other contact information from your mobile address book or contact lists – only mobile phone numbers. Our Products associate a name with a mobile phone number on the mobile device itself. We do not transmit any information to our servers other than mobile phone numbers.

When We Disclose Information

We do not share information you provide (such as mobile phone number) with other third-party companies for their commercial or marketing use without your consent. We may disclose information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law), international law or respond to a court order, subpoena, or search warrant or equivalent, or where in our reasonable belief, an individual’s physical safety may be at risk or threatened.   We also reserve the right to disclose information that we believe, in good faith, is appropriate or necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend itself against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our servers, and to protect the rights, property, or personal safety of SOI, our users or others.

If SOI is involved in a merger, acquisition, or sale of all or a portion of its assets, we will notify you of any changes of ownership or uses of your information, as well as any choices you may have regarding your information.

Access to Your Information

We aim to provide you with access to your personal information where you have the means to view, edit, and remove your personal information. You may request that we remove or edit your personal information at any time by contacting us using our “Contact Us” form. When we receive your request, we will use commercially reasonable efforts to update or even delete the personal information from our servers. When we delete information, it will be deleted from the active database, but may remain in our archives. We may retain your anonymous information on our servers.

Children’s Privacy

Our Products are not direct to children under the age of thirteen (13) and we do not knowingly collect personally identifiable information from children under the age of thirteen. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us using our “Contact Us” form. We will remove such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. Access to all personally identifiable information is restricted to those SOI employees, contractors, agents and third-party service providers who need to know the information in order to provide, operate, develop, maintain, support or improve our Products. We use password protection, access logs, and system monitoring to safeguard the confidentiality and security of all personal information.

In addition, due to the inherent nature of the internet and related technology, we do not guarantee the protection of information under our control or in transit against loss, misuse, or alteration.

Changes to this Privacy Policy

This Privacy Policy may be revised periodically and this will be reflected by the “effective date” below.

Your Consent

Your use of our Products signifies that you agree with the terms of this Privacy Policy now and as amended by us. If you do not agree with the terms of this Privacy Policy, do not use our Products.
